 The Visa process

After you and your  Filipina fiancee have gotten married in the Philippines. You and your Asawa will be ready to start the visa process. The visa she will need will be the IR-1/CR-1 visa. the diffrent in a IR-1 and a CR-1 visa is the amount of time a couple have been married  at the time of  your asawa POE ( port of entry) in the U.S.A .

A IR-1 visa is for those that have been married more then two years at time of POE. Your Filipina spouse will recieve a 10 year green card.

A Cr-1 visa is for those that have been married less then 2 years at time of POE. Your Filipina wife will recieve a 2 year green card ( conditional green card.) ROC ( removing of conditions) will be done later before the 2 year green card expire. At that time your spouse will recieve a 10 year green card. Also keep in mind that your Filipina spouse is eligible to apply for citizenship after 3 years of being married to you

 

There are two ways to do the visa process. The fastest way will be if you are living in the Philippines with your Asawa then you can apply for her visa thru DCF direct consulate filing.)  However the requirement is that the U.S citizen must be a residence of the Philippines for at least 6 months in order to do DCF. If you are able to do the visa  this way. I will highly recommend you do it that way.

 

For those who live in the U.S.A and thier Filipina spouse is in the Philippines then you will do the IR-1/CR-1 visa the most common way( this is the way me and my wife did her visa)

there are 4 parts of the process.  the first is theUSCIS part. Youn will send a petition to the USCIS.( United States Citizen Immigration service)The USCIS is part of Homeland security. The USCIS  will make sure all the paperwork is done correctly and make sure the person is actually eligible for the visa. After the USCIS has approve the petition. Your case will then be sent to the NVC.which is part of the department of state.

The NVC is the where the actual visa application is submited. They will gather and check all documents and determine wheather to approve the visa application or not. Once the NVC approves your case. The NVC will schedule your spouse an interview at the U.S embassy in Manila ( unlike a K-1 fiancee visa you do not m have to schedule your interview)

Once your interview has been schedule. You and your spouse will need to schedule the medical at ST. Lukes.
