USCIS process

The USCIS is the first process in bringing your Asawa to the USA.

To complete the process, the petitioner must submit:

  • Form I-130 (signed with proper fee of $420.00),   with all required documentation, including:

     

    • Two completed and signed G-325A forms (one for you and one for your spouse)

    • A copy of your civil marriage certificate The certifcate needs to be NSO( now know as PSA) copy or you will probably recieve a rfe( request for  evidence)

    • A copy of all divorce decrees, death certificates, or annulment decrees that demonstrate that all previous marriages entered into by you and/or your spouse were terminated

    • Passport style photos of you and your spouse (US size 2'"x2")

    • Evidence of all legal name changes for you and/or your spouse (may include marriage certificates, divorce decrees, court judgment of name change, adoption decrees, etc.)

    • If you are a U.S. citizen, you must demonstrate your status with:

       

      • A copy of all pages   of your valid U.S. passport OR

      • A copy of your U.S. birth certificate OR

      • A copy of Consular Report of Birth Abroad OR

      • A copy of your naturalization certificate OR

      • A copy of your certificate of citizenship

    • If you are a green card holder (permanent resident), you must demonstrate your status with:

       

      • A copy (front and back) of Form I-551 (green card) OR

      • A copy of your foreign passport bearing a stamp showing temporary evidence of permanent residenc

      • you will also want to provide proof of your relationship do not worry if you do not have joint accounts or a house together. The USCIS  knows that most couples living in diffrent countries will not neccesary have that. Instead you should sent in passport stamps of visit. boarding pass, reciepts picture of you and your spouse and family. copies of text and chat msg. How much you send is up to you. the main thing is that you want someone to be able look at your evidence and know that you and your spouse relationship is genuine

      • You should also  include G-1145 E-Notification of application/petition acceptance.Once the USCIS Recieves your petition  and assign it to one of the sevice  centers that handles IR-1/CR-1 visa petitions ( the address that you sent the petition to is only the lockbox).

      • YOU will recieve a form I-797 also know as NOA1( notice of action) that your petition has been accepted  and is being sent to name of service center

      • Once the USCIS send your case to a service center you will have a case number that you can use to track your case progress on the USCIS website

      • https://egov.uscis.gov/casestatus/landing.do

      • After that you will either recieve another I-797aka NOA2. approval of your petition or an RFE. 

      •  If you log onto your account and notice you have an RFE. You will just have to wait for the RFE letter and follow the instructions.  It will do no good to call the  USCIS, they can not tell you over the phone what the RFE is for
