NVC

 

The NVC is the second part of bringing your Asawa to the USA. Once the USCIS approves your Petition. Your case will be forward to the NVC. It might take a while for the NVC to recieve case and assign case number and invoice number. you will recieve a welcome letter fom the NVC but do not wait for that as that will delay your case if you do. You should start calling the NVC at (603) 334-0700  a couple of weeks after your Noa2 (petiton Approve from  USCIS) to get your case and invoice number. They are open 7am to 12 midnight Est. I found the best  time to call is early in the morning right when they open. I have also heard that  late at night before they close is a good time to call when calling for first time you will need your USCIS case number and birth-dates of petioner and beneficary

 

While you are waiting for the NVC to assign your case and invoice number. you should start gathering require documents. The US citzen will need financial documents (AOS packet) your asawa will need copies of her documents (IV packet)

Copies your asawa need to include are

NSO (PSA)copy of marriage certificate

NSO (PSA) copy of birth certificate

NBI cleareance in all names use

Notice If the NBI clearance says "No Criminal Record" or "No Pending Case" then an explanation from the NBI is required that statement was confusing to me as i thought it meant if my wife did not have a criminal record she would need explanation.,but my wife knew that  you only need explination if the NBI clerance states that.

Police clearance from any other countries live. the NBI clearance is the only one needed if  Philippines is only county live in.

Photocopy of the biographic data page of your valid passport

Court and prison record

Marriage Termination Documentation

Military Records

 and any other documents that is applicable to your case.

 

After you have receive the case number and invoice number,you can go to CEAC ( Consular Electronic Application Center) website and log in

your first step will be to fill out the DS-261 form.

It designate who will recieve notices from the NVC regarding case status. It is best to make the US spouse the designator . However  it really  does not matter.The Philippine spouse can be  it or a third party can be. One thing to rememeber   Do not click back on the Ds-261 form after you have completed it, as it will restart the 30 days the NVC  state that is needed for reviewing of the DS-261

 

after you  fill out the DS-261 form you can pay the AOS fee ($120.00). the fee must be paid thru a US bank account. an alternative way to pay is thru the mail.

After you paid The AOS fee you should send in both the AOS and the IV packets.You will need a bar code cover sheet. you can use the one included with the  NVC welcome letter or you can print one from the AOS  payment portal  on your  CEAC account.Send both packets to the address on the bar code cover sheet. Also include the document check list that comes with the NVC welcome letter. (You do not have to wait for the IV fee to be paid or the Ds-260 form to be fill out before the packets are sent.)

 

There are Two processes involve with the NVC one is the paymet of fees and filling out the two forms, the other is reviewing of the documents. After you send in documents you will want to call the NVC for two reasons. One to see if they receive your documents.The date they receive your documents that will be your scan date. If the NVC is not backlog. It normaly takes 30 days for them to review documents. For my wife case it took 42 days as we sent our document in Feb 2015. The NVC was close several times due to snowstorms. So if it has been 30 days do not panic yet.If it has been much much longer then you might want to call and maybe get your congressman involve.

 

The second reason you will want to call is that you will want to see if they can review your DS-261 form on the phone  as your IV fee will not show untill the Ds-261 choice of agent has been review.If an agent tells you it is  not ready yet then you could probably wait another  week to call back . If an agent tells you that he/she can not do that you should

call back  and speak to another agent, as some agents can not or will not do that. It took me 4 calls. I call once a week for first and 2nd week after I sent in my documents. The third week I call twice. An  agent  finally review the DS-261 over the phone for me.

 

After your Ds -261 form has been review ,you will then be able to pay the IV fee($325.00)

If you decide to pay the fees by mail it will delay your case. So if possible  You should pay the fees online

After you paid the IV fee then you will be able to fill out the DS-260 immigration form. On the form it will ask about your medical record. Some people worry about that question. If you do not have, or can not get medical record check no and write will have for interview.

 

Once you have fill out the Ds-260 form. You can relax as your case should be close to being complete, unless you have a check list for documents. I do not like to think negative, I am hoping no one gets a checklist.however it does happen. If you do get one you will just need to follow the instructions in the letter you receive. Some helpful info to avoid checklist.

 Double ,triple check everything. If you want to.  have someone also check

There are different I-864 forms to use for the AOS make sure you are using correct form. Use the I-864ez form if you can. (there are three requirement you need to meet to use it.) It is a shorter form and less likely for a person to make mistakes.

 

Send in the  right tax info. if you send in copies of your tax return form then you need copies of anything else you sent in to the IRS, w-2 , 1099 etc,etc,

If you send in a copy of the IRS transcript of your taxes you only need that. It is an offical record of your taxes.

sending in a tax transcript is less likely you will forget to send a copy of something you sent with your tax return. So if all possible send in a tax transcript.

Also use the right amount for tax info. Form 1040 and 1040A it is total gross income (line 22 for 1040 form) 1040ez it is adjusted gross income

 

Do not wory if your current income and total income on your tax form do not match up. Current income is what you expect to make for the year. Income on tax form is what you actually did make for year 

Current income is current income. It is not jobs you work or income you made durning the year. It is the income you are now making. It is gross income not net income. To determine current income  for most . Use the  formula( pay per hour x average hours work per week x 52 weeks in year.)

 

 Unlike when your case was at the USCIS where you had to wait for them. At the NVC you can help speed up the process. You can and should call the NVC often. phone number  (603) 334-0700   learn it remember it put it on speed dial.
